    Terms of Service

By using our platform, you agree to these terms.

    Effective Date: April 22, 2026  ·  Version 2.1  ·  Last Updated: June 22, 2026  ·  Changelog

    1. About Choice Properties

Choice Properties ("Choice Properties", "we," "us," "our," or "the Platform") provides rental homes managed by the Choice Properties team. Our management team maintains listings, reviews applications, communicates decisions, coordinates leasing, and supports residents through move-in.

    2. Acceptance of Terms

By accessing or using Choice Properties as a visitor, applicant, or resident, you agree to be bound by these Terms of Service, our Privacy Policy, and any additional policies linked from this page. If you do not agree, do not use the platform.

    3. Who Can Use This Platform

    • You must be at least 18 years of age to submit a rental application.
    • You must provide accurate, complete, and truthful information. Providing false information is grounds for immediate account suspension and may be referred to relevant authorities.
    • You are responsible for all activity that occurs under your account or your submitted application.

    4. Platform Role — What We Do and Do Not Do

    Choice Properties management provides:

    • Listings for rental homes managed by Choice Properties
    • Application review and status communication
    • Resident support from application through move-in
    • Lease preparation and electronic signing

    Choice Properties does NOT:

    • Guarantee approval of any rental application
    • Guarantee that a listing will remain available until a lease is executed

    5. Listings

Choice Properties management publishes and maintains rental listings. Listing details and availability can change; applicants should rely on the current listing and written information provided by our team.

    6. Applications

Submitting an application does not guarantee approval, reserve a home, or create any tenancy. Choice Properties management reviews applications and communicates the decision. The process is: Apply → Fee → Review → Decision → Reservation → Lease → Move-In. Review begins after required application steps are complete. Timing varies with application completeness and the information that needs review.

    7. Fees

The application fee is $50 for each adult applicant or guarantor being screened, and the total is shown before you apply. Adult occupants who are not applying or being screened are not charged. Nothing is charged when you submit. Choice Properties management will contact you with the next steps for completing the fee. Fees are subject to applicable law; requirements vary by location. By submitting your application and completing payment, you acknowledge and agree that:

    • The application fee is non-refundable except where required by applicable law or where Choice Properties management confirms an exception in writing
    • The fee covers processing of your specific application for that specific property
    • Payment of the fee activates your application for review but does not guarantee approval or create any tenancy

    8. Application Fee Adjustments

There is no automatic application-credit program. Any exception or fee adjustment must be approved by Choice Properties management and confirmed to you in writing before it is applied.

    9. Holding Deposit

If selected, you may be asked to pay a holding deposit to reserve the property and remove it from active availability while your lease is prepared. The holding deposit is fully credited toward your move-in costs — it is not an additional charge. Holding requests are time-sensitive and typically must be completed within 24 to 48 hours; if not paid in time, the property may be released to other approved applicants. The terms, refundability, and conditions of the holding deposit are governed by the Holding Deposit Policy.

    10. Electronic Signatures and Records

Lease agreements and other legally significant documents executed through the Choice Properties platform are legally binding pursuant to the federal Electronic Signatures in Global and National Commerce Act (ESIGN Act, 15 U.S.C. § 7001 et seq.) and, where applicable, the Uniform Electronic Transactions Act (UETA) as adopted in your state. By signing electronically, you agree that your electronic signature has the same legal effect as a handwritten signature.

Consent to electronic records. Before receiving any electronically delivered legally significant record (including your lease), you are hereby informed of: (1) your right to request a paper copy of any electronically delivered record by contacting us at 707-706-3137; (2) your right to withdraw this consent at any time, though withdrawal may affect your ability to complete transactions on the platform; and (3) the requirement that you keep your email address current to receive electronic delivery. By completing an application, you affirmatively consent to receive legally significant records electronically.

    11. Choice Properties Management

Choice Properties management is responsible for maintaining listings, reviewing applications, communicating decisions, and coordinating the leasing process.

    • Maintain accurate listing details and update availability when it changes
    • Review applications consistently and communicate decisions
    • Follow applicable fair-housing requirements

    12. Prohibited Conduct

You may not use this platform to:

    • Post false or fraudulent listings
    • Submit applications using another person's identity
    • Engage in any activity that harasses, harms, or defrauds another user
    • Circumvent, disable, or interfere with platform security features
    • Use automated bots, scrapers, or tools to access platform data

    13. Data and Privacy

Your use of this platform is governed by our Privacy Policy, which is incorporated by reference into these Terms. Please read it carefully.

    14. Platform Availability and Changes

We make no guarantee of uninterrupted service. The platform may be updated, modified, or temporarily unavailable at any time. We reserve the right to change these Terms at any time. For material changes — those that meaningfully affect your rights or obligations — we will provide at least 30 days' advance notice via email or a prominent notice on the platform before the change takes effect. For non-material changes (corrections, clarifications, formatting), no advance notice is required. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.

    15. Disclaimer of Warranties

The platform is provided "as is" without warranties of any kind, express or implied. We do not warrant that listings are accurate, that applications will be approved, or that the platform will be free of errors or interruptions.

    16. Limitation of Liability

To the maximum extent permitted by law, Choice Properties shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to loss of a tenancy opportunity, application fees paid, or damages arising from landlord decisions. Total aggregate liability of Choice Properties to you is limited to the amounts paid in connection with your application or use of the platform in the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.

    17. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles, unless a specific federal or state law mandates otherwise for housing-related matters. Property-specific matters are governed by the laws of the state in which the property is located.

Nothing in these Terms limits any rights you may have under Michigan's Consumer Protection Act (MCL § 445.901 et seq.), the federal Fair Credit Reporting Act, the Fair Housing Act, the Electronic Communications Privacy Act, or other applicable state or federal consumer protection laws. Where applicable law affords you greater protection than these Terms, applicable law controls.

    18. Dispute Resolution & Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Informal resolution first. Before initiating arbitration, either party must provide the other with written notice describing the dispute in reasonable detail and a proposed resolution. The parties will have 30 days from the date of that notice to attempt to resolve the dispute informally. Arbitration may not be commenced until this 30-day period has elapsed without resolution. Notice to Choice Properties must be sent to: 707-706-3137.

Opt-out right. You may opt out of this arbitration agreement by sending written notice to 707-706-3137 within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out. Opting out does not affect any other terms.

Any dispute, claim, or controversy arising out of or relating to your use of Choice Properties shall be resolved through final and binding individual arbitration administered under the Consumer Arbitration Rules of the American Arbitration Association (AAA), where permitted by law. Arbitration shall take place in the State of Michigan or, at your election, in your home state. The arbitrator's decision shall be final and may be entered as a judgment in any court of competent jurisdiction.

Either party may bring an individual claim in small-claims court for disputes within that court's jurisdiction in lieu of arbitration. Nothing in this section prevents either party from seeking injunctive or equitable relief in court for intellectual-property infringement or unauthorized access.

    19. Class Action Waiver

YOU AND CHOICE PROPERTIES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class-action waiver is held unenforceable as to any particular claim or remedy, that claim or remedy (and only that claim or remedy) shall be severed and brought in a court of competent jurisdiction; all other claims shall remain subject to arbitration.

    20. Force Majeure

Choice Properties is not responsible for delays or failures in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, civil disturbance, government action, labor disputes, utility or telecommunication failures, and outages of third-party infrastructure providers (including Cloudflare, Supabase, Google, ImageKit, and our payment partners).

    21. Communication & SMS Consent

By using the platform and providing your contact information, you consent to receive emails, text messages, and application updates from Choice Properties. These may include payment coordination, status updates, lease processing, and administrative communication.

SMS consent. By providing your mobile number and submitting an application, you expressly consent to receive transactional SMS messages from Choice Properties relating to your application, payment coordination, lease, and move-in. Consent to receive SMS is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply HELP for help. Reply STOP at any time to opt out of SMS; opting out of SMS does not remove you from email communications necessary to process your application.

    22. Application-First Model & Property Access

Choice Properties operates a structured application-first system. By using this platform, you acknowledge that:

    • Applications are required before any property access
    • Screening is conducted before approval — applications are reviewed, and approvals are issued, prior to lease execution
    • Physical property access is coordinated only after the lease is fully executed and all required move-in costs are paid

This system ensures serious applicants, efficient processing, and fair and consistent evaluation across all listed properties.
